1. General Provisions.

1.1. This Public Offer (hereinafter referred to as the "Offer") is an official proposal from "KLIMATRON EUROPA" (hereinafter referred to as the "Aggregator"), PIB 115366219, address: Beograde, Resavska Street, 33, to the user (hereinafter referred to as the "User") to conclude an agreement on the terms set forth in this Offer.
1.2. The Aggregator is a platform-aggregator that provides information about goods (air conditioners and related products), installation and delivery services offered by third parties (sellers, suppliers). The Aggregator is not a seller of goods and bears no responsibility for the quality, delivery, or other aspects of transactions between the User and third parties.
1.3. Acceptance of the Offer is carried out by registering on the website https://klimatron.rs (hereinafter referred to as the "Site"), placing an order, or otherwise using the Site's functionality. Acceptance of the Offer means the User's full and unconditional acceptance of all the terms of the Offer.
1.4. The Aggregator reserves the right to make changes to the Offer unilaterally. The new version of the Offer comes into force from the moment it is posted on the Site.

2. Subject of the Offer.

2.1. The subject of the Offer is the provision of access to the Site for the User to view information about goods (air conditioners), compare offers from various sellers, place orders through the Aggregator, and receive related services (for example, consultations on selection).
2.2. The Aggregator acts solely as an intermediary, collecting and displaying information from third parties. All transactions are concluded directly between the User and the seller.
2.3. The User agrees to use the Site in accordance with the terms of the Offer and applicable legislation of the Republic of Serbia.

3. Rights and Obligations of the Parties.

3.1. The Aggregator undertakes to:
- Provide access to the Site and its functionality 24/7, except during maintenance periods.
- Provide up-to-date information about goods and services based on data from sellers.
- Ensure the functionality of the Site within its competencies.
3.2. The Aggregator has the right to:
- Deny access to the Site in case of violation by the User of the Offer's terms.
- Use the User's data in accordance with the Privacy Policy regulated by legislation.
3.3. The User undertakes to:
- Provide accurate data during registration and placing orders.
- Not use the Site for illegal purposes, including spam, hacker attacks, or violation of third-party rights.
3.4. The User has the right to:
- Receive information about goods and place orders.
- Refuse services at any time.

4. Disclaimer of Liability.

4.1. The Aggregator bears no responsibility for:
- The accuracy, completeness, or relevance of information about goods and services provided by third parties (sellers).
- The quality, safety, compliance with descriptions, or delivery of goods or services purchased through the Site.
- Losses incurred by the User as a result of using information from the Site, including indirect, incidental, or lost profits.
- Failures in the Site's operation caused by force majeure circumstances (natural disasters, hacker attacks, etc.).
- Actions of third parties, including sellers and couriers.
4.2. The Site is provided on an "as is" basis. The Aggregator provides no guarantees of uninterrupted operation of the Site or the absence of errors.
4.3. The User independently bears the risks associated with the selection and purchase of goods. It is recommended to verify information with the seller before completing a transaction.

5. Copyright and Intellectual Property.

5.1. All materials on the Site, including text, images, logos, design, software code, and databases (hereinafter referred to as the "Content"), are objects of intellectual property of the Aggregator or third parties that have granted rights to their use.
5.2. The User is granted a non-exclusive license to use the Content solely for personal non-commercial purposes. Copying, distribution, modification, or commercial use of the Content is prohibited without the written consent of the Aggregator.
5.3. The User guarantees that any materials uploaded by them to the Site (for example, reviews, photos) do not violate the copyrights of third parties. In case of claims from third parties, the User bears full responsibility.
5.4. The Aggregator has the right to delete any user content that violates this Offer or the legislation of the Republic of Serbia.

6. Confidentiality and Processing of Personal Data.

6.1. The Aggregator collects and processes the User's personal data in accordance with the Law on Personal Data Protection of the Republic of Serbia ("Official Gazette of the Republic of Serbia" No. 87/2018) and the Privacy Policy posted on the Site.
6.2. The User consents to the processing of their data for the purposes of fulfilling the Offer, including the transfer of data to third parties (sellers, payment systems).
6.3. The Aggregator undertakes to ensure the confidentiality of the User's data and not to disclose it to third parties without the User's consent, except as required by law.
6.4. The User has the right to access their data, request corrections, or deletion in accordance with applicable legislation.

7. Dispute Resolution.

7.1. All disputes arising from the Offer are resolved through negotiations. If settlement is impossible, disputes are considered in court at the location of the Aggregator in accordance with the legislation of the Republic of Serbia, including the Law on Electronic Commerce and the Law on Consumer Protection.
7.2. The Offer is governed by the legislation of the Republic of Serbia.

8. Final Provisions.

8.1. The Offer is effective from the moment of acceptance until its termination.
8.2. If any provision of the Offer is declared invalid, the remaining provisions remain in force.
